Terms of Service

These Terms of Service ("Terms") govern your access to and use of outAnswer (the "Service"), operated by outAnswer ("outAnswer", "we", "us", or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms.

If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity, in which case "you" and "your" refer to that entity.

1. The Service

outAnswer provides Generative Engine Optimization (GEO) tools and managed services that help brands track and improve their visibility in AI search engines such as ChatGPT, Perplexity, Claude, and Google AI Overviews.

We may update, modify, or discontinue features at any time. We will give reasonable notice for material changes that affect your subscription.

2. Your account

To use the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Keep your login credentials confidential
  • Notify us promptly of any unauthorized use
  • Be responsible for all activity that occurs under your account

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.

3. Plans, billing, and trials

Subscription plans

The Service is offered on a subscription basis. Plan details, features, and pricing are described on our pricing page. All amounts are in USD unless stated otherwise.

Payment

You authorize us (or our payment processor) to charge your payment method on a recurring basis according to your chosen plan. Subscriptions renew automatically until cancelled.

Refunds

Except where required by law, fees are non-refundable. You can cancel at any time from your account settings; cancellation takes effect at the end of your current billing period.

Free trials

If we offer a free trial, the trial converts to a paid subscription at the end of the trial period unless you cancel beforehand.

Taxes

Fees do not include taxes. You are responsible for any applicable taxes, except for taxes based on our net income.

4. Acceptable use

You agree not to:

  • Use the Service to violate any law or third-party rights
  • Reverse engineer, scrape, or copy the Service, except as expressly permitted
  • Resell, sublicense, or share access to your account without our written consent
  • Submit false, misleading, or infringing content
  • Interfere with the Service's security or performance
  • Use the Service to send spam or unsolicited communications
  • Use the Service to train competing AI models or build a competing product

We may suspend or terminate accounts that violate this section.

5. Your content and data

You retain ownership of any data, content, prompts, brand information, or other materials you submit to the Service ("Your Content").

You grant us a worldwide, non-exclusive, royalty-free license to host, process, and use Your Content solely to provide and improve the Service for you. We will not sell Your Content or use it to train public foundation models.

You are responsible for ensuring you have the rights to submit Your Content and that it does not infringe any third-party rights.

6. AI-generated outputs

The Service produces analyses, recommendations, drafts, and other outputs ("Outputs") using third-party AI engines and our own models. You acknowledge that:

  • Outputs may be inaccurate, incomplete, or out of date
  • Identical or similar outputs may be generated for other customers
  • You are responsible for reviewing Outputs before relying on or publishing them
  • We do not guarantee that following our recommendations will produce any specific result, including improved rankings or AI visibility

7. Third-party services

The Service may integrate with or reference third-party platforms (such as OpenAI, Anthropic, Google, Perplexity, and analytics providers). Your use of those services is governed by their respective terms. We are not responsible for third-party services.

8. Intellectual property

We and our licensors own all rights, title, and interest in the Service, including all software, designs, branding, and documentation. These Terms do not grant you any rights to our trademarks or other brand features.

We welcome your feedback. If you submit feedback, you grant us a perpetual, royalty-free license to use it without restriction.

9. Confidentiality

Each party agrees to protect the other party's non-public information with the same care it uses for its own confidential information, and only use it to perform under these Terms.

10. Termination

You can terminate your account at any time from your settings. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if your account is inactive for an extended period.

On termination, your right to use the Service ends immediately. We will make a reasonable effort to allow you to export Your Content for 30 days, after which we may delete it.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT OUTPUTS WILL BE ACCURATE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUTANSWER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS IS LIMITED TO THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

13. Indemnification

You agree to indemnify and hold outAnswer harmless from any claim arising from (a) Your Content, (b) your use of the Service, or (c) your breach of these Terms.

14. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will notify you by email or in the Service at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.

15. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which outAnswer is established, without regard to conflict-of-laws principles. Any dispute will be resolved in the competent courts of that jurisdiction, unless mandatory consumer protection law provides otherwise.

16. Miscellaneous

These Terms, together with our Privacy Policy, are the entire agreement between you and outAnswer regarding the Service. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver.

You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
